We strive to operate our company at the highest level of ethical business practice and, as a component of that, your information privacy is honoured in all we do.

Your privacy is important to us. GiftTool understands the concerns that our clients have with protecting the integrity of their customer information. We also understand the concerns your customers have with using their credit cards online or providing their personal information online. The following information is your assurance of security and privacy regarding the information that may be exchanged as you, the client, and your customers use our “Services” (the products, applications or services provided by GiftTool).

1. Information Collected From Clients

In order to provide you with our Services, we must ask you to provide your name, company name, address, email address, phone number(s), IP address, payment details (for example, your credit card or company banking information), business type, and business ID number.

  • We use this information to allow you and your customers to interact with our Services (for example, to confirm your identity, to process your online transactions, to provide you with reports on activity in your account, to invoice you, and to contact you with information regarding our Services).
  • We use this information to make sure that we comply with applicable legal and regulatory requirements.
  • We may also use personal information in other cases where you have given us your express permission.

We collect personal information about your customers that you share with us or that your customers provide to us while interacting with our Services. We use this personal information to provide our Service to you and your customers and so that you can fundraise online, manage your events, members and surveys, issue tax receipts, sell merchandise and other items, and better serve your customers.

We may use some of this information to conduct some level of automated decision-making, such as to help us screen accounts for risk or fraud concerns.

We collect data about the GiftTool websites that you visit, including how and when you access your GiftTool account (for example, information about the device and browser you use, your network connection, your IP address, and information about how you browse through your GiftTool account).

  • If contacted by your customers, we may share your contact information so that you can provide them with assistance.
  • We share this information, and only that information which is absolutely necessary, with those third parties that you have specified to conduct the processing of your financial transactions (for example, the financial institution with whom you have your payment gateway or internet merchant account).
  • GiftTool may disclose this information to prevent, investigate, or take action with regards to illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.
  • GiftTool may disclose specific information when we determine that such disclosure may be helpful to conform to legal requirements; or to respond to lawful court orders, subpoenas, warrants; or to cooperate with or seek assistance from law enforcement or national security to protect the interests or safety of GiftTool or other visitors to the Site or users of Services provided by GiftTool; or to take part with others in joint antifraud activities.
  • In the event of a transfer of ownership or assets of GiftTool, whether through merger, acquisition, asset sale, bankruptcy, dissolution, reorganization, or other similar transaction or proceeding, we may transfer information from or about you to one or more third parties as part of the transaction or proceeding, including the due diligence process.

We collect our clients’ customers’ name, company name, shipping and billing address, email address, phone number(s), IP address, payment details (for example, credit card information), information about orders and interactions with the Service they initiate, information about the GiftTool websites that they visit, information about their network connection, information about how and when they access their user account, and information about the device and browser they use.

  • We use this information to allow you and your customers to interact with our Services (for example, to confirm their identity, to perform risk and fraud screening, to authenticate and process their online transactions and credit card payments, and to provide them with reports on activity and other functionality in their user accounts).
  • We use this information to make sure that we comply with applicable legal and regulatory requirements.
  • We use this information to give your customers’ access to and interact with our Services; and to continuously improve the content, performance, and ease-of-use of our Services and Site.
  • We use some of your customers’ personal information you or they provide in the course of a payment transaction, such as IP addresses and payment information, to conduct some level of automated decision-making to automatically block potential fraudulent transactions for a short period of time.
  • As clients, you have the ability to collect additional information from your customers during the donation, registration, fundraising, survey, testing or online shopping process.

When We Collect This Information

  • We collect personal information when you or your customer uses, accesses or otherwise interacts with our Services, such as when visiting a donation or other GiftTool-hosted e-commerce sites, processing a transaction, signing up or logging into a user account, completing an online survey, or otherwise when you provide us with their information.

When and Why We Share This Information with Third Parties

  • GiftTool works with a variety of third parties and service providers to help provide our clients with our Services and we may share personal information with them to support these efforts.
  • We share this information, and only that information which is absolutely necessary, with those third parties that you have specified to conduct the processing of your financial transactions, (for example, the financial institution with whom you have your payment gateway or internet merchant account).
  • We may share this information with those third parties managing the third party apps that you have added to your GiftTool-hosted webpages (such as Google Analytics or other social media tracking technologies). For more details, see section "6. INFORMATION COLLECTED FROM THIRD PARTY APP COOKIES" below.
  • GiftTool is not responsible for any uses of customer information by you or your organization.
  • We may disclose certain aggregate use statistics (for example, 50% of customers used a Visa card, or the number of visitors in a given time period) in order to describe our Services to prospective partners, investors, and otherwise relevant third parties. Such disclosed information will not include any personal information about individual customers.
  • GiftTool may disclose this information to prevent, investigate, or take action with regards to illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Use, or as otherwise required by law.
  • GiftTool may disclose specific information when we determine that such disclosure may be helpful to conform to legal requirements; or to respond to lawful court orders, subpoenas, warrants; or to cooperate with or seek assistance from law enforcement or national security to protect the interests or safety of GiftTool or other visitors to the Site or users of Services provided by GiftTool; or to take part with others in joint antifraud activities.

  • As you visit or browse the GiftTool websites, we collect information about the device and browser you use, your network connection, your IP address, and information about the cookies installed on your device.
  • When a visitor or user requests more information about our Services, we collect certain personal information, such as your name, company name, job title, address, email address, phone number, business type, and/or business website address.
  • From telephone support users, we collect your name, phone number, email address and other personal information you provide to us during the call.
  • We also collect any additional information that you might provide to us.

We use this information to answer any questions you may have, to provide or enhance our Services, and to support or service your account.

We collect this information when you visit the GiftTool websites, use Services offered on our websites or contact with us by phone, email, or online form on our website.

  • With your permission, we may disclose your personal information to a third party payment processor, so that they may contact you to answer your questions about credit card processing.
  • We may disclose certain aggregate use statistics (for example, the number of visitors in a given time period) in order to describe our Services to prospective partners, investors, and otherwise relevant third parties. Such disclosed information will not include any personal information about individual customers.

4. Information Collected From Children

GiftTool Services and websites are for a general audience. We do not knowingly collect information about children or sell our Services to children under the age of 16. If you are under the age of 16, you must ask your parent or guardian to assist you in using our Services or websites.

5. Information Collected From GiftTool Cookies

Cookies are small text files that are stored on your computer or device to recognize your device and provide you with a personalized experience on our websites, such as completing an online purchase, registration or donation, keeping you logged into your user account, or other interaction through the Services. Such cookies can also help us improve our Services.

GiftTool only uses cookies that are essential for continuity when a client or user clicks through multiple pages during a browser session. Most GiftTool Services, such as logging into a user account or completing an online transaction, would not work without these essential cookies. Our cookies will track only your activity relating to your online activity on our website, and will not track your other Internet activities. The cookies used by GiftTool don’t persist past the life of the browser session. Upon closing your browser, the cookie is destroyed.

GiftTool does not track its customers over time and across third party websites to provide targeted advertising. Nevertheless, the GiftTool platform does allow our clients to add third party apps to their GiftTool-hosted webpages which might (see the next section for further details). "Do Not Track" (DNT) is a preference that users can set on their browser (if supported) to opt-out from online behavioral tracking done by various companies. GiftTool does not respond to DNT signals or other such mechanisms sent by your Internet browser because a uniform technological standard has not yet been developed.

6. Information Collected From Third Party App Cookies

The GiftTool platform does allow our clients to add third party apps to their GiftTool-hosted webpages (such as Google Analytics or other social media tracking technologies), which may also use cookies to collect personal information. GiftTool is not responsible for and has no control over how these third party apps function. Ultimately, our clients can control which apps they choose to use with their hosted pages, and are responsible for making sure that they do so in compliance with relevant privacy and data protection requirements. If you are unable to change your third party app settings within your account, please contact us to make the required changes.

7. Consequences of Not Providing Data

You are not required to provide personal data to us. However, failing to provide such data may affect our ability to provide the Services and fulfill your requests (for example, we cannot provide you access to the Services without authorizing you as a user for your organization).

8. Once Your Client Relationship With GiftTool Has Terminated

As a general rule, we will continue to store archived copies of your personal information for legitimate business purposes and to comply with the law, except when we receive a valid erasure request or, if you are a client, you terminate your account and your information is purged pursuant to our standard policies and procedures.

In order to improve our Services, we will continue to store anonymized information, such as website visits, without identifiers once you terminate your relationship with GiftTool.

9. Keeping Your Personal Information Secure

This site has security measures in place to protect the loss, misuse and alteration of the information under our control. All customer information and records of transactions are stored in an encrypted form and we have installed extensive security measures to prevent unauthorized access to our database. As required by PCI DSS compliance regulations, we utilize industry standard TLS strong encryption when accepting credit card information. In addition, we utilize the same encryption standard when transferring credit card data to an external fulfillment system. To help us protect your privacy, you should maintain the secrecy of the login ID and password you may have set up in connection with your participation in any GiftTool Services.

No method of electronic storage or transmission over the Internet is truly 100% secure. Although we make every attempt as required by PCI DSS compliance regulations, we cannot guarantee the absolute security of your personal information.

10. Your Rights Over Your Personal Information

GiftTool understands that your personal data belongs to you, and takes reasonable steps to allow you to access, correct, amend, delete, port or limit the use of your personal information.

If you are a client, you can update many types of personal information, such as contact information, directly within your account settings. If you are unable to change your personal information within your account settings, or if you are concerned about data collected as you visit the GiftTool websites or use our support services, please contact us to make the required changes.

If you are a customer of a GiftTool client who uses our Services and wish to exercise these rights, please contact the client you interacted with directly -- we serve as a processor on their behalf, and can only forward your request to them to allow them to respond. Additionally, if you are a customer with a fundraising or membership account, you may have the ability to login to your account and access, correct, amend, copy or delete certain personal information directly.

It’s important to remember that if you delete or limit the use of your personal information, the Services may not function properly.

11. What We Don’t Do With Your Personal Information

GiftTool does not disclose, sell, trade, or rent your personal information to outside parties (other than to specific GiftTool clients you are interacting with if you are a customer, or to third party apps as specified by our clients, or to third party payment processors as required by our clients to complete a credit card transaction) for the marketing of their own products or services.

Furthermore if you are a client, GiftTool does not use your customers’ data to market directly to your customers. Nevertheless, we may contact or market to your customer, if a customer subsequently reaches out to GiftTool directly or via another source to inquire about our Services.

12. Residents Of The European Economic Area ("EEA")

If you are located in the EEA, you have certain rights under European law with respect to your personal data, including the right to request access to, correct, amend, delete, port to another service provider, or object to certain uses of your personal data.

  • If you are a client, a visitor of a GiftTool website, or a user of GiftTool support services and wish to exercise these rights, please contact us using the contact information below.
  • If you are a customer of a GiftTool client who uses our Services and wish to exercise these rights, please contact the client you interacted with directly -- we serve as a processor on their behalf, and can only forward your request to them to allow them to respond.

Additionally, if you are located in the EEA, we note that we are generally processing your information in order to fulfill contracts we might have with you, or otherwise to pursue our legitimate business interests listed above, unless we are required by law to obtain your consent for a particular processing operation. In particular we process your personal data to pursue the following legitimate interests, either for ourselves, our clients, or other third parties (including our clients’ customers):

  • To provide clients and others with our Services;
  • To prevent risk and fraud on our platform;

GiftTool reserves the right to change this statement at any time by posting revisions on the GiftTool Website. This privacy policy is not intended to, and does not, create any contractual or other legal rights in or on behalf of any party.

From time to time, GiftTool may introduce new Services to its users. To the extent these new Services affect this policy, this policy will be updated and will be effective immediately upon posting to the GiftTool Website. Although we may attempt to notify you when major changes are made via the Notice email address associated with your account, you agree to assume responsibility for periodically reviewing this privacy policy.
